Authority: Ordinance O-21-27 establishes the Ethics Commission of Missouri City.
Objectives: Pursuant to said authority and in accordance with City of Missouri City Strategic Goal No. 4 (developing a high performing City team), the City Council established the volunteer Ethics Commission to investigate and address certain complaints against City officials, in an orderly manner. The term “City official” means the mayor, each member of the City Council, each member of a City board or commission, the City manager, the City attorney, and the City secretary.
Qualifications: The volunteer Ethics Commission will be appointed by the City Council and will consist of seven (7) voting members. Once constituted, the Ethics Commission will elect its own chairperson. To serve as a member of the Commission, a person must meet the following minimum requirements:
- be a resident of Missouri City;
- be over 18 years of age;
- may not have a conviction for a Class B misdemeanor or higher or a conviction for a crime of moral turpitude.
- may not be related, in any degree, to a City official that is in office; and
- within the three years prior, may not have been:
- a City official or City employee;
- a campaign treasurer, campaign manager, officer or other policy or decision-maker for the campaign of any candidate elected to City Council, while that candidate is in office;
- a donor to the campaign of any City official;
- a campaign treasurer, campaign manager, officer or other policy or decision-maker for any political action committee as defined in V.T.C.A. Texas Election Code; or
- a member of any City board or commission other than the Ethics Commission.
Appointment Process: To apply to serve on the Commission, an individual must submit an application and a resume to Missouri City by Feb. 28, 2022. The City Council may waive an applicant’s failure to submit a resume. By submitting an application, each applicant attests to the applicant’s eligibility. An application will not be considered and an appointed individual may be removed from the Commission if the individual is later found to be ineligible. Additionally, providing false or misleading information in an application to serve on the Commission will serve as grounds for removal after appointment. Membership on this Commission is subject to approval by the City Council.
Term: Each Commissioner will be assigned a position and will be designated Commissioner Number 1 through Commissioner Number 7. Each Commissioner will serve an approximately three (3) year staggered term and will serve until their respective successors are appointed. The terms of the even-numbered positions appointed in 2021 will expire on June 30, 2023. Thereafter, the terms of all positions will expire on June 30 of the applicable expiration year.
Meetings and Rules of Procedure: Meetings of the Ethics Commission may be scheduled on a quarterly basis or as needed. The Ethics Commission will adopt rules of procedure to conduct its meetings, including a determination hearing.
