The City of Missouri City Website Privacy Policy

This policy describes the privacy practices of the City of Missouri City (the “City”) regarding information collected from visitors to the City’s website (the “Privacy Policy”). It contains information about what data is collected and how that information is used by the City. This Privacy Policy applies only to this website. When you leave the City’s website by clicking and following a link to another site, even the sites of state agencies and other local governments, this Privacy Policy will not apply. You should check the privacy policy of each of these other sites if you have concerns about how such websites handle the collection and disclosure of personally identifiable information. This Privacy Policy may be updated periodically, so please check back from time to time. Any changes will become effective immediately upon the posting thereof, and usage of the City’s website constitutes acceptance of any changes made.

Collection and Use of Information 

The City does not sell or rent personally identifiable information. Personally identifiable information includes, but is not limited to, a visitor’s name, address, and contact information; unique identifying numbers such as a social security number or driver’s license number; financial data such as bank account, electronic checking, or credit or debit card information; and any other information that may be collected in a form or survey on the City’s website. Please be aware that when you provide such information to the City, however, that information may be subject to the Texas Public Information Act and applicable federal legislation. Information about the Texas Public Information Act is available from the Office of the Attorney General at http://www.oag.state.tx.us/opinopen/open_policy.shtml. Each governmental body must be contacted directly about the records they keep and their use of personally identifiable information.

If you do nothing during your visit but browse through the City’s website, read pages, or download information, the City may use server logs and log analysis tools to automatically gather certain information about your visit. This information does not identify you personally. The City may also automatically collect and store information such as the following about your visit: the internet domain and IP address (an IP address is a number that is automatically assigned to your computer whenever you are surfing the Internet) from where you access the City’s website; the type of browser and operating system used to access the website; computer monitor resolution; the date and time of the visit; the pages you accessed during the visit; and if you linked to the City’s website from another website, the address of that website. The City may use this information to assess what information is of most interest to users, to determine technical design specifications, and to identify system performance or problem areas.

The City’s website contains online forms such as transactional input forms and surveys. In such forms, the visitor will be asked to enter certain personally identifiable information which will vary depending on the type of form. In each case, the information requested will include the same information that would be requested if the visitor performed the identical transaction in person rather than online. Whenever personal information is requested, there will be an indication of whether the visitor’s disclosure of such information is mandatory or optional in order to continue the transaction. The City limits employee access to personally identifiable information to only those City employees who need access to perform a specific task. Such personal information collected may be used to conduct online transactions with the City, including, but not limited to: paying permit fees and municipal court fines and costs; sending an email to confirm a transaction; forwarding announcements about news, new services, events, or content features; and conducting surveys.

The City’s online surveys may request contact or demographic information. The City uses contact data from surveys to determine the identity of individuals who complete the survey. Demographic data is used for compilation purposes relating to the survey subject matter only.

The City may be required by law enforcement or judicial authorities to provide personally identifiable information, as well as any other collected data, to the appropriate governmental authorities. The City will fully cooperate with law enforcement agencies to identify those who use the City’s website for illegal activities, and reserves the right to report to law enforcement agencies any activity that the City, in good faith, believes to be unlawful.

Mobile Applications

The City of Missouri City’s public applications are titled “MCTX Mobile” and “Missouri City iReport” in most app stores and are provided by CivicPlus. Missouri City iReport utilizes SeeClickFix, an online and mobile service request system CivicPlus uses to power its mobile app and reporting forms. SeeClickFix is an application that allows Missouri City residents to report non-emergency related issues to our various City departments, and can be used via the Web on a desktop computer, laptop, mobile phone, or tablet.

The description and information entered on SeeClickFix will be visible to the public. Your display name will also be visible unless you choose to submit a request anonymously. Your email address will never be displayed publicly.

Cookies

To help the City make its website more responsive to the needs of its visitors, standard features of browser software called “cookies” may be used. A cookie is a small text file that is stored on your computer and assigns each visitor a random and unique number. The cookie does not give the City any private information about you or read data unrelated to your use of the City’s website off your computer; it does, however, tell the City that a previous visitor has returned. If your browser is set to notify you before accepting a cookie, you will receive a request for a cookie to be stored on your computer. You must accept cookies in order to access some applications on the City’s website.

Ownership of Intellectual Property

All Site software, design, text, images, photographs, illustrations, audio clips, video clips, artwork, graphic material, or other copyrightable elements, and the selection and arrangements thereof, and trademarks, service marks and trade names (the "Material") are the property of the City, its assigns, licensors, or other respective owners and are protected, without limitation, pursuant to U.S. and foreign copyright, trademark and other applicable laws. The Material may not be reproduced, modified, displayed, performed, published, distributed, disseminated, broadcasted or circulated to any third party (including, without limitation, the display and distribution of the Material via a third party website) without the prior written consent of the City. The City may not be disassembled, decompiled, reverse engineered or otherwise modified. Any unauthorized or prohibited use may subject the offender to civil liability and criminal prosecution under applicable federal and state laws.

Indemnification and Limitation of Liability

By using this website, each user agrees to indemnify, defend and hold harmless, the City, its officers, employees, agents, licensors, representatives, and third party contractors and content providers from and against all losses, expenses, damages and costs, including reasonable attorney’s fees, resulting from any violation of this Privacy Policy or any misuse of the website by the user.

The City is not responsible or liable for any infections or contamination of your system, or delays, inaccuracies, errors, or omissions arising from your use or access of the City’s website. The entire risk as to the quality, accuracy, adequacy, completeness, correctness and validity of any material rests with you, and the City, its officers, employees, agents, licensors, representatives, and third party contractors and content providers shall not be liable for damages of any kind, including, without limitation, compensatory, consequential, incidental, indirect, special or similar damages that may result from use of, or inability to use, the materials contained on the City’s website.
